Terms of use

  1. These Terms and Conditions govern the use of the littleflowers.com.au website (Website) and the purchase of any goods from it. The Website is owned and operated by Little Flowers AU Pty Ltd (ABN 63 606 159 568) (we or us or Little Flowers).
  2. Please note that by using the Website or ordering goods and/or services from us, the user or purchaser (you) agrees to be bound by the terms, conditions, disclaimers and limitations of liability contained in the webpages comprising the Website. You also acknowledge that you have read and understood these Terms and Conditions. We reserve the right to amend or update all information on the Website including these Terms and Conditions at any time without providing notice other than publication on the Website.

Offer of Goods and Services

  1. We offer to supply the daily bunch of flowers featured on the home page of the Website for the price and subject to and in accordance with the terms and conditions noted on the Website, subject to availability.
  2. We also offer, subject to these Terms and Conditions, a photo upload and delivery service whereby you may for a small additional charge upload a photographic image to us for printing by us and delivery with your flowers (Photo Service).

Prices and Payment

  1. Price given on home page includes delivery. The price may change without notice, but any new price will be clearly displayed on our home page.
  2. All prices are quoted in Australian dollars.
  3. We accept payment by Visa, Mastercard, PayPal and American Express.

Photo Service

  1. When you place an order with us you may choose to upload a photographic image (Photo) to us via your computer or mobile device to be added to the tag that will be delivered with the flowers. If you choose to add a Photo, an additional fee (the Photo Fee) will be payable as indicated on the ordering page. Further details about the Photo Service will be shown which you will need to be aware of and/or comply with.
  2. The Photo must be within certain dimensions as indicated in the Photo Service details and if it is not, you must crop it so that it is not greater than the maximum size indicated. A cropping tool will be provided to assist you in framing the photo correctly for the tag.
  3. We reserve the right to not send the Photo and refund the Photo Fee if the Photo if in our opinion the Photo is offensive or if we experience technological problems which can sometimes occur. However we do not offer a vetting service and accept no liability for sending the Photo to the recipient. We will try to contact you if the Photo will for any reason not be delivered, to see if you would like to
    1. send the flowers without the Photo,
    2. delay sending the flowers and Photo until the Photo is replaced or can be printed or
    3. cancel the order altogether and give you a full refund,

    but if we can’t get your instructions by our cut off time we will send the flowers without the Photo, and refund only the Photo Fee.

  4. Photos and the tags on which they appear are not enveloped, so you accept that the Photo and tag may be easily viewed by persons other than the intended recipient.
  5. In the unlikely event that your Photo is sent to an incorrect recipient, due to human or technical error, no liability can be accepted by us.
  6. Any complaint about the Photo Service or our use of the Photo must be made within 14 days after the day the Photo is uploaded to us.
  7. We will store your Photo for a period of 30 days after which our system will delete it. This gives sufficient time, should any problem have arisen in relation to your initial order, to re-use the Photo without the need for further upload. We will not send back your Photo and will not intentionally send it to any person other than the recipient initially nominated by you.
  8. Due to the potential for uploading malware, all files including photos uploaded to our system will undergo a series of security checks, analyses and measures. You consent to us undertaking these security actions in respect of your Photo.
  9. You warrant that you own the copyright in the Photo or are licensed by the copyright owner and have the authority to license or sublicense us to digitally store and print the Photo and to deliver the Photo to the recipient in the manner disclosed in the Website including these Terms and Conditions (Authorised Photo Use).
  10. You agree to indemnify Little Flowers and its officers, agents, employees and volunteers (Indemnified Persons) and to hold the Indemnified Persons harmless from and against any and all liability, causes of action, claims, loss, damage costs and/or expenses suffered by any of the Indemnified Persons in respect of or in connection with the Authorised Photo Use.

Ordering

  1. For Little Flowers to put your order through, we need some personal information from you, eg your name, contact details including email address and/or mobile number, billing address, delivery address and payment details.
  2. For information on how we obtain, store and use your personal information please see our Privacy Policy, below.
  3. Payment will need to be confirmed as having been received by our bank, before we can send your flowers.
  4. You should receive an email confirming your order once your payment has been processed. If you don’t, there may have been a problem with processing your order. Please let us know if this happens by emailing hi@littleflowers.com.au

Delivery

  1. We currently operate in Sydney only. Delivery area is currently restricted to the following areas : Alexandria, Annandale, Artarmon, Ashfield, Balmain, Beaconsfield, Bellevue Hill, Ben Buckler, Birchgrove, Bondi, Bondi Beach, Bondi Junction, Broadway, Bronte, Cammeray, Camperdown, CBD (Sydney), Centennial Park, Chatswood, Chippendale, Circular Quay, Clovelly, Coogee, Cremorne, Crows Nest, Darlinghurst, Darlington, Darling Harbour, Darling Point, Double Bay, Dover Heights, Drummoyne, Dulwich Hill, East Sydney, Edgecliff, Elizabeth Bay, Enmore, Erskineville, Eveleigh, Five Dock, Forest Lodge, Glebe, Glebe Point, Greenwich, Haberfield, Haymarket, Kensington, Kirribilli, Kurraba Point, Lavender Bay, Leichardt, Lewisham, Lilyfield, Marrickville, Mascot (not airport), McMahon’s Point, Millers Point, Milsons Point, Moore Park, Mosman, Naremburn, Neutral Bay, Newtown, Northbridge, North Sydney, Paddington, Petersham, Point Piper, Potts Point, Pyrmont, Queens Park, Randwick, Redfern, Rose Bay, Rosebery, Rozelle, Rushcutters Bay, Russell Lea, St Leonards, St Peters, Stanmore, Summer Hill, Surry Hills, Sydenham, Sydney University, Tamarama, The Rocks, Town Hall, Ultimo, Vaucluse, Walsh Bay, Waterloo, Watson’s Bay, Waverley, Waverton, Willoughby, Woollhara, Wooloomooloo and Zetland.This is subject to change and will be updated on the Website as the changes occur.
  2. Our delivery hours are between 9.00am and 5.30pm for business addresses and 9.00am to 7.00pm for residential addresses. Please note we are not able to guarantee delivery at a specific time of day.
  3. We’ll leave flowers at, or near, the door, or in another place we deem safe if there is no answer when we deliver. If necessary, we will contact the recipient to let them know where we’ve left their flowers. If there is nowhere safe to leave them we’ll call the recipient and / or you to re-arrange delivery.

Availability of product

  1. Only one style of a bunch of flowers is available on any given day.
  2. A limited number of bunches are available each day. The home page will be updated when flowers are no longer available to purchase, stating that the style has sold out.
  3. Occasionally, the flowers in the bunch featured for sale may be substituted with alternative flower types if stock runs low during the day. However, our florists will make sure that the bunch with the substituted flowers resembles the featured bunch as closely as possible. If it results in a dramatically different style, then we will telephone you, or send you an email or SMS (notify you).

Advance orders

  1. If you choose to ‘send on a later date’ you accept that you will not see the style of flowers until the day of delivery, when it will be too late to change your order.
  2. If we encounter any supply issues we will  notify you  as soon as practicable and give you the option of either obtaining a full refund or resending your flowers on an alternative day.

Days of operation

  1. Little Flowers does not operate on weekends, public holidays or over the Christmas period (unless we expressly state otherwise on the Website) so flowers cannot be sent on these days.

Warranties, refunds and cancellations

  1. Due to our quick turn around times we are unable to refund your payment if you change your mind about a ‘send now’ purchase.
  2. We are unable to offer a refund if incorrect delivery information is given to us. It’s your responsibility to make sure you provide us with detailed and accurate delivery instructions.
  3. If the wrong delivery address is given we can re-deliver, but this will be a separate order at the normal full cost.
  4. For advance orders, any cancellations must be made 24 hours in advance. Cancellations can be made by emailing hi@littleflowers.com.au
  5. Like people, every flower is different and some are more delicate than others. You should expect your flowers to last at least 3 days. If for any reason (excluding extreme spikes in temperature) they last less than 3 days, or you’re not happy with your order, please let us know immediately so we can do our best to make things right.
